Right of access
You (as the data subject) have the right to access your personal data and any other supplementary information we hold about you in accordance with the General Data Protection Regulations (GDPR).
Under the GDPR, you have the right to obtain:
- confirmation that your data is being processed
- access to your personal data, and
- other supplementary information – this largely corresponds to the information that should be provided in any privacy notice
Requesting right of access
You can exercise this right by using the council’s online subject access request form.
The council will respond to your request within one month from the date of receipt. The council has the authority to extend this period by a further two months, where requests are complex or numerous. If this is the case, you will be notified within the original one month deadline and will be informed of the reason why the extension is necessary.
A copy of the information requested will be provided free of charge. However, the council may charge a ‘reasonable fee’ when a request is manifestly unfounded, excessive or repetitive. If the council processes a large amount of information about you, the GDPR permits us to ask you to specify the information the request relates to. The council’s Data Protection Officer will make this decision and this will be relayed to the data subject prior to commencing the request.
The council may also refuse to answer your request if it is considered to be unfounded, excessive or repetitive. If we refuse to answer your request, we will provide you with the reasons for such refusal along with information on how to contact the Information Commissioner if you wish to complain.
To ensure we provide you with the correct information, you will be asked to verify your identify and if required, we may also ask you for further information to verify your identity or location. Please refer to section four of the subject access request form for details of the type of information which is required. Please do not send any original documentation as the council cannot be responsible for any loss or damage to this.
